1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and EvadeGPT ("Company," "we," "us," or "our"). By accessing, browsing, or using our website, applications, software, or any related products, features, or services (collectively, the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

If you do not agree with any part of these Terms, you must not access or use our Services. These Terms incorporate by reference our Privacy Policy and Refund Policy, which are integral parts of this agreement.

2. Description of Services

EvadeGPT provides AI-powered text humanization and detection bypass services. Our Services use artificial intelligence and machine learning technologies to process and transform text content to make it appear more human-written and to help bypass AI detection systems. The Services are provided "as is" and may be modified, updated, or discontinued at any time without prior notice.

3. Intellectual Property Rights

All content, features, functionality, software, designs, graphics, logos, text, data, and other materials contained in or made available through the Services (collectively, "Content") are the exclusive property of EvadeGPT, its licensors, or other content providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

The EvadeGPT name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of EvadeGPT or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans are the trademarks of their respective owners.

4. License Grant and Acceptable Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal or internal business purposes. This license does not include any resale or commercial use of the Services or their contents.

5. User Accounts and Registration

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this requirement.

You may not share your account credentials with any third party or allow anyone else to access your account. Each account is for use by a single user only.

6. User Content and Submissions

You retain ownership of any text, data, or other content you submit, upload, or transmit through the Services ("User Content"). However, by submitting User Content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content (in whole or in part) for the purpose of operating, providing, and improving our Services.

You represent and warrant that: (a) you own or have the necessary rights to grant the license set forth above; (b) your User Content does not infringe the rights of any third party; (c) your User Content does not violate any applicable laws or regulations; and (d) your User Content is not defamatory, libelous, or otherwise harmful.

We reserve the right, but are not obligated, to monitor, review, edit, or remove User Content at any time, without prior notice, for any reason, including if we determine that such content violates these Terms or is otherwise objectionable.

7. Subscription Plans and Billing

We offer various subscription plans with different features, usage limits, and pricing. By subscribing to a paid plan, you agree to pay the fees associated with that plan.

Billing Cycles: Paid plans are billed in advance on a monthly or annual basis, depending on the plan you select. Your subscription will automatically renew at the end of each billing cycle unless you cancel.
Payment Authorization: By providing payment information, you authorize us (or our third-party payment processor) to charge your payment method for the subscription fees and any applicable taxes.
Price Changes: We reserve the right to modify our pricing at any time. If we increase the price of your plan, we will provide at least 30 days' notice, and the new price will apply to your next billing cycle after the notice period.
Proration: If you upgrade your plan mid-cycle, you will be charged a prorated amount for the upgraded plan based on the remaining time in your current billing cycle. Downgrades take effect at the start of your next billing cycle.
Usage Limits: Each plan includes specific usage limits (e.g., word processing limits). If you exceed these limits, you may be required to upgrade your plan or wait until the next billing cycle. Unused limits do not roll over to subsequent billing periods.

8. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle. You will continue to have access to the Services until the end of the paid period, after which your account will revert to the free plan (if available) or be terminated.

9. Service Availability and Modifications

We may also update, change, or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes.

11. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EVADEGPT, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICES.

Our total liability for any claims arising out of or relating to the Services shall not exceed the amount you paid to us in the three (3) months preceding the event giving rise to the claim. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless EvadeGPT, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Services, your User Content, or your violation of these Terms.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EvadeGPT operates, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Services shall be resolved exclusively in the courts of that jurisdiction, unless applicable law requires otherwise.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
